ExComS AI Marking Agent Terms of Use

1. Agreement
These Terms of Use (“Terms”) are a legal agreement between you (and, if applicable, the institution or organisation you represent) and Express Communication Services Limited, trading as ExComS (“ExComS”, “we”, “us”), governing your use of the ExComS AI Marking Agent, including any free trial and any paid subscription (the “Service”). By creating an account or using the Service, you accept these Terms. If you are using the Service on behalf of an institution, you confirm you are authorised to bind it.
Company registration details: Express Communication Services Ltd, company number 08099517, registered office 960 Capability Green, Capability Green, Luton, LU1 3PE. The Service is developed by ExComS Innovation Center Ltd (company number 10982946).
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. The Service is for professional use by teachers, lecturers, trainers, and their institutions. You are responsible for your account, for keeping your sign in credentials secure, and for all activity under your account.
3. What the Service does
The Service drafts per-criterion scores, rationale, and student facing feedback for submissions you upload against a rubric you define, and learns your marking standard from the corrections you make. It is a marking assistant, not a marker. Every AI drafted result requires your review and confirmation before it stands (see section 8).
4. Free trial
We offer a free 30 day trial with usage caps (currently up to 500 pages graded, 20 rubrics, 5 documents per batch, and 10 pages per document; caps may change). No payment details are required for the trial. We may limit, change, or withdraw the trial at any time; one trial per account.
5. Subscriptions, plans, and billing
- Plans. Paid plans are billed per user, monthly or annually (annual billing carries a 20 percent discount): Solo at US $49 per user per month (up to 100 papers per month, 5 mark schemes), Standard at US $69 per user per month (up to 300 papers per month, 15 mark schemes, AI content detection), and Pro at US $99 per user per month (up to 500 papers per month, 20 mark schemes, full feature set). Prices are stated in USD as the Microsoft Commercial Marketplace base currency; other display currencies are Microsoft’s conversion and may vary. Allowances may be adjusted between plan revisions with notice.
- Microsoft is the merchant of record. Paid plans are sold through the Microsoft Commercial Marketplace. Purchase, billing, invoicing, payment, taxes, refunds, and cancellation are handled by Microsoft under its own commercial marketplace terms, which apply in addition to these Terms. We do not receive or store your card or bank details.
- Auto-renewal. Subscriptions renew automatically each billing period until cancelled through the Microsoft channel used to purchase.
- What happens to your data if you cancel. Your content remains under your control and is deleted per the Privacy Policy’s retention rules; you can delete papers, batches, rubrics, or your whole account at any time, before or after cancelling.
6. Your content and intellectual property
- You keep your content. You (or your institution) retain all rights in the rubrics, reference materials, and submissions you upload, and in the confirmed marks and feedback you produce (“Your Content”). We claim no ownership of Your Content.
- The licence you grant us. You grant ExComS a limited, non-exclusive licence to host, copy, and process Your Content solely to provide the Service to you (extracting text, drafting grades, calibrating to your corrections, producing audit records). The licence ends when the content is deleted under the Privacy Policy’s retention rules.
- No training on Your Content. We do not use Your Content, or your students’ content, to train AI models.
- You are responsible for what you upload. You confirm that you (or your institution) are entitled to process the submissions you upload, and that uploading them does not infringe any third party’s rights. Where your institution’s policy requires it, anonymise submissions before upload.
- Our IP. The Service itself (software, models, prompts, and underlying technology) is owned by ExComS or our licensors. These Terms grant you a licence to use the Service, nothing more.
7. Acceptable use
You agree not to: misuse or disrupt the Service; attempt to gain unauthorised access to another user’s data or account; reverse-engineer the Service except as permitted by law; resell or provide the Service to third parties except under an authorised arrangement; upload malware or unlawful content; use the Service to make decisions about individuals without the human review it is designed around; or use the Service to violate any law or any institution’s assessment policy.
8. AI drafted marks and human confirmation (important)
The Service’s scores, rationale, and feedback are drafts produced by an AI model. They may contain errors, and they are not an awarding decision.
- You must review and confirm. The Service requires the marker to confirm each paper’s result, with a recorded attestation, before it stands. The confirmed mark is your professional decision, not ours.
- You remain the marker of record. Responsibility for grades awarded to students, for compliance with your institution’s assessment and quality assurance policies, and for any appeals process, rests with you and your institution.
- Calibration is an aid, not a guarantee. The Service learns from your corrections to draft closer to your standard over time; it does not guarantee agreement with your judgement on any given paper.
9. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we make no warranty that the Service will be error free, uninterrupted, or fit for any particular purpose, including any particular assessment, awarding, or regulatory context.
10. Limitation of liability
To the maximum extent permitted by law, ExComS is not liable for indirect, incidental, special, or consequential losses, or loss of profit, revenue, data, or goodwill, including any consequence of releasing an unreviewed AI draft as a final mark contrary to section 8. Our total aggregate liability arising from or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).
11. Suspension and termination
You may stop using the Service and close your account at any time; the in product deletion controls remove Your Content immediately. We may suspend or terminate access if you breach these Terms, fail to pay (including where Microsoft notifies us your subscription lapsed), or where necessary to protect the Service or other users. On termination, your right to use the Service ends and Your Content is handled per the Privacy Policy.
12. Changes to the Service and these Terms
We may update the Service and these Terms. We will post updated Terms here and revise the date above; where changes are material, we will notify users where appropriate. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory local law provides otherwise.
