These Terms of Use (“Terms”) govern your access to and use of the ExComS AI WiFi Survey Agent and related websites, applications, and APIs (the “Service”), provided by Express Communication Services Ltd, trading as ExComS (“ExComS”, “we”, “us”). By creating an account, subscribing, or using the Service you agree to these Terms. If you are using the Service on behalf of an organisation, you confirm you are authorised to bind that organisation.
Company registration details: Express Communication Services Ltd, company number 08099517, registered office 960 Capability Green, Capability Green, Luton, LU1 3PE. The Service is developed by ExComS Innovation Center Ltd (company number 10982946).
1. The Service: predictions, not measurements (important)
The Service produces predictive Wi-Fi coverage models, access point placement recommendations, and survey reports from floor plans you provide. Predictions are engineering estimates generated by software models, including AI inference of wall positions and materials from your plans, and are not a measured (on site) survey. Real world performance depends on factors outside our control (actual construction, interference, hardware, configuration, environment). You are responsible for validating critical designs on site before relying on them for business critical decisions, procurement, or installation.
2. Accounts and eligibility
The Service is for business and professional use by users aged 18 or over. Authentication is provided via Microsoft Entra. You are responsible for activity under your account and for keeping access credentials secure.
3. Subscriptions, plans, and billing
Paid plans are sold on a per seat basis with a monthly allowance of floor plans (one floor plan per building floor); plans, allowances, and prices are described on the Microsoft Commercial Marketplace listing at the point of purchase. Where you purchase through the Microsoft Commercial Marketplace, billing, taxes, payment, refunds, and cancellation are handled by Microsoft under its terms, which apply in addition to these Terms; your plan, seat count, and allowances determine your charges. Subscriptions renew automatically until cancelled through the channel used to purchase. Free trials, if offered, convert to read only on expiry unless a paid plan is selected.
4. Acceptable use
You agree not to misuse the Service, including: uploading content you have no right to use; attempting to disrupt, reverse-engineer, or gain unauthorised access to the Service; reselling or providing the Service to third parties except under an authorised arrangement; uploading malware or unlawful content; or using the Service unlawfully. We may suspend access for breach.
5. Your content
You retain all rights in the floor plans, designs, and outputs you upload or generate (“Customer Content”), including the coverage models and reports generated for you. You grant us a limited licence to host, process, and display Customer Content solely to provide the Service. You confirm you have the rights necessary to upload any floor plan or material you provide. We do not use your Customer Content to train AI models.
6. Intellectual property
We and our licensors own the Service, including its software, models, and branding. These Terms grant you a licence to use the Service; no other rights are granted except as expressly set out here.
7. Availability and disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law we disclaim all implied warranties. We do not warrant that predictions are accurate, that AI inferred wall materials or placements are correct, or that the Service will be uninterrupted or error free.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability arising out of or in connection with the Service is limited to the fees you paid for the Service in the twelve months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).
9. Term and termination
Either party may terminate in accordance with the applicable plan. You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or where necessary to protect the Service or other users. On termination your right to use the Service ends; we delete Customer Content in line with the retention rules in the Privacy Policy.
10. Changes
We may update the Service and these Terms. Material changes will be notified through the Service or by email; continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory local law provides otherwise.
